Q: fraud or not ? what should i do .?
i recently found a dodge charger 2006 for 4,500
perfect condition to good o be true
i emailed the guy and he replied to me saying:

I am selling this car because my unit will be sent back to Iraq and don’t want it getting old in my garage. The price is low because I need to sell it before June 5th. The car is in great condition and runs great. No damage, no scratches, never involved in an accident. It is still available for sale if interested, price as stated in the ad The car is in Longmont, CO; in case it gets sold i will take care of shipping total cost with shipping is $4500.(2006 Dodge Charger ) Heated Leather Seats it’s in perfect condition, it has only 39872 miles,it’s almost brand new, never damaged or accidentted, no scratches, no dents or hidden defects…it’s just the way it looks it is and the paint is in great shape. The engine (5.7L V8 EFI DOHC ) starts and runs awsome.I will ship it with DAS and I think I can have it there in 3-4 working days. he gave me his number and the number is not in the area code where he said he lived.
so i want to meet in person make sure where the car is but from the looks of it i think its a fraud .
so what do you guys think i should do .

Q: Bought a used car, found out it was wrecked, having safety problems now, what can i do?
I bought a 2006 Dodge Charger R/T with 56k on it in November 2009. We’ve found out since then the car has been wrecked and cheaply fixed, meaning things are missing or not replaced properly, plus frame rail is cracked. Now we’ve discovered the airbag light does not come on when you turn on the car, which in the owners manual tells you there is something wrong with the air bag system. We bought this car in New York and we’re from PA. In the car lots office they had a sign posted that all cars were safety inspected before being put up for sale. Do I have a leg to stand on if I open a claim with an attorney agains this lot? Really I just want the money to fix the car properly, But i’m thinking i’m stuck paying a $300 car payment for a smashed up car. Cost of airbags alone is around $3000 or more. Please help i need ideas!
We did not have someone inspect the car for the simple fact of us being out of state. the car did not have an inspection sticker on it when we bought it. Besides regular inspection does not include the mechanic tearing out the airbox in the car which is where we found the cracked frame rail. Nor does it require them testing for airbags.
This just in, i pulled a car fax, the car was wrecked and disabled (towed from scene) in MD 10/2008 the car was then retitled in 3/2009 to an auto auction & then sold to a dealer around 9/2009 and we bought it 11/2009. Something tells me the car was sold wrecked. But there are no records of airbag deployment, where the car was repaired at or if there was frame damage. From what i read on NY dmv site cars have to be inspected before sold or tranferred titles. THere was no inspection sticker on the car.
The only paperwork i received with the car was a pink slip sales contract. there was no paper in the window stating as is or no warranty however the sales guy did mention it didn’t have a warranty except a 90 day on the engine and transmission.
So i’ve found there is an airbag but light is still not working….thinking bad sensor or it wasn’t replaced after accident. Ya know i was looking for answers not someone chewing me out for buying something without all the correct info. I”M NOT FROM NEW YORK i didn’t know there inspection laws or if it even applys to a car being sold and transferred to another state. If you have no useful information for me then post on someone else’s question.

A: Sorry, a 4-year old car with 56K miles is not going to qualify for any Lemon Laws in any state. A few states have Lemon Laws for used vehicles, but the one caveat that always is in place is that the vehicle is still under the manufacturer’s original warranty. An accident and the subsequent fix are not reasons for filing Lemon Law claims.

However, there are plenty of greedy lawyers out there that’ll try for you.

It is the buyer’s responsibility to have any vehicle inspected by a mechanic prior to purchase. You purchased the vehicle “as-is” unless noted in writing.

That being said… and playing “devil’s advocate” for a second… since the airbag warning indicators do not come on, this COULD be a safety hazard and would warrant a fix from the dealer. You need to go back to the dealer and calmly work something out with them (I wouldn’t expect them to try another fix on the accident damage, but the airbags warrant a look). If they refuse, then go after legal remedies. However, don’t go in there yelling “Lemon Law!” unless you want them to laugh at you.
